Judge to Paris: Get Back Here!Posted Jun 7th 2007 8:24PM by TMZ Staff Filed under: Celebrity Justice, Paris Hilton TMZ has learned that a judge has ordered Paris Hilton back to his Los Angeles courtroom, telling her she must attend tomorrow morning's hearing. She could be sent BACK to the slammer!!
Late today, L.A. City Attorney Rocky Delgadillo filed paperwork demanding a hearing before Judge Michael Sauer to determine why the Sheriff's Department allowed Paris to get out of jail when the judge had expressly ordered her to serve out her entire sentence.
The hearing is scheduled for 9:00 AM PDT on Friday.
TMZ contacted the Sheriff's Department, but they refused to comment on the case. In the documents obtained by TMZ, City Attorney Rocky Delgadillo is also asking Judge Michael Sauer to hold a hearing, demanding that the Sheriff's Department show why it should not be held in contempt of court for violating Judge Sauer's May 4, 2007 order, which expressly stated "no electronic monitoring."
Late this afternoon, the judge granted the request for a hearing, which is now scheduled for 9:00 AM PDT tomorrow.

According to BestWeekEver, Dina is en route from Long Island to Los Angeles, and will soon be reunited with her 20-year-old wild child. While in L.A., Dina will babysit Lindsay's dogs as well, reports BestWeekEver. Yes, Dina's going to the dogs.
Though several of Lindsay's "friends" have stopped by to see how she's doing, Dina is the first family member to do so.

Meanwhile, famed author Dominick Dunne mulled around outside. He told reporters that he was in town for the Phil Spector trial, but just had to check out the scene at Chateau Hilton. Dunne actually expressed a twinge of regret about Paris leaving jail early, saying, "I think she should have served out the whole thing. I think she could have come out a heroine. Man, I don't know, this sounds like rich kid stuff."
First Don King says Paris is "what America is all about," now Dunne calls her a would-be "heroine." What a day.

In a statement to TMZ, Los Angeles City Attorney Rocky Delgadillo said:
"Today I was extremely troubled to learn that the Sheriff's Department has decided to release Ms. Hilton from custody just three days after she was admitted to county jail.
My office was not advised of this action. We learned of it this morning through news reports, just like everyone else. Had we been provided with the proper notification, we would have opposed the decision on legal grounds.
News reports indicate that the Sheriff's Department released Ms. Hilton to house arrest due to a medical condition. This explanation is puzzling. Los Angeles county jail medical facilities are well-equipped to deal with medical situations involving inmates.
I am also concerned that the judicial process may have been improperly circumvented in this case. Ms. Hilton was incarcerated as a condition of her probation. As a result, the judge retained jurisdiction over her case and only the judge has the power to modify these conditions of probation. If Ms. Hilton's medical condition truly warranted a change in her circumstances, what should have happened is the following: Ms. Hilton's legal counsel should have filed an emergency application with the court and provided my office with the opportunity to respond, and then the court could have held a hearing on the matter to consider whether there was sufficient justification to change the terms of his original order. I have directed my criminal branch to immediately explore all possible legal options to ensure that the law is being applied equally and justly in this case.
If law enforcement officials are to enjoy the respect of those we are charged with protecting, we cannot tolerate a two-tiered jail system where the rich and powerful receive special treatment. We must ensure that in our city, in our nation, and under our Constitution, justice remains blind." Sheriff's Department.
TMZ has confirmed that Judge Michael T. Sauer was informed of the Sheriff's decision before Hilton was reassigned to house arrest, but the Judge only responded by reaffirming the terms he imposed on May 4.
We spoke to Allan Parachini, Public Information Officer for the Los Angeles County Courts, who advises that "All decisions on incarceration are made by the Los Angeles County Sheriff's Department once a sentence is imposed."
So don't tell it to the judge.
UPDATE: Allan Parachini addressed the media outside of a Los Angeles County Courthouse regarding Paris Hilton's early release today, and reiterated that the court did not sanction the early release of Miss Hilton. He added that the Sheriff's Department contacted Judge Sauer on June 6 and asked him to change his sentence to allow electronic monitoring for Hilton. He declined, sticking by his original sentence, which clearly nixed that type of punishment.

L.A. County law enforcement officials tell TMZ Paris is wearing the Sentinel DualTrak ankle bracelet, which operates on a radio frequency and comes with a Home Monitoring Unit. The heiress must stay within 500 feet of the unit. The bracelet, which has an internal backup battery life of 50 hours, snaps on, so Paris won't need to worry her purty little head with any tools or complicated strap harnesses. Get your mind out of the gutter! For hygienic reasons, the bracelet also comes with a disposable back plate, which eliminates any tedious cleaning on Paris' part. Phew!
Law enforcement officials tell TMZ that Paris' house arrest does not come with any provisions regarding visitors or restrictions on alcohol use.

Psychiatrist Charles Sophy visited Hilton in jail yesterday and the day before. We're told after Sophy's visit yesterday, word was passed to the Sheriff that Hilton's mental state was fragile and she was at risk.
The reason for releasing her had nothing to do with a rash or other physical issues. It was purely in her head.
Last month, on the eve of a trial in which Hilton was accused of slandering socialite Zeta Graff, Dr. Sophy told the judge that Hilton was "emotionally distraught and traumatized" over her jail sentence, which prevented her from participating in a meaningful defense. That trial was put on hold until August.
UPDATE: Law enforcement sources have just told TMZ the County Jail medical team made the final decision to spring Paris based on Dr. Sophy's psychological evaluation. And we're told, Sheriff Lee Baca gave the final approval.

"Paris Hilton was granted a conditional sentence in Los Angeles Metro Superior Court on January 22, 2007. A conditional sentence or "summary probation" is monitored by the court for compliance unless the court orders formal probation. Although not on formal probation, Ms. Hilton is supervised by the Los Angeles County probation department in regards to electronic monitoring.
Electronic Monitoring is an integral part of community-based alternatives to custody. The Electronic Monitoring (EM) program is available to Los Angeles County Courts as an alternative to custody in accordance with penal code. The probation department contracts with a private vendor to provide electronic monitoring services. Eligible post-sentence inmates are screened for eligibility or it may be court-ordered either prior to conviction as a pretrial release or after conviction as a sentence option.
Paris Hilton applied for the community based alternative to custody program and qualified as low-risk but the department did not recommend Electronic Monitoring because the court order specified ''no Electronic Monitoring.' The Sheriff Department exercised the authority to reassign Ms. Hilton to an Electronic Monitoring sentence." Cox's voice could barely be heard telling the paps, "that's good ... there's nothing happening" over the heckling of the group. Prez Steve Remige told TMZ, "There appears to have been preferential treatment." Remige added, "This is not the first time that this has happened. Remember Mel Gibson."
Remige believes preferential treatment is coming from Sheriff Lee Baca himself. Baca has denied giving preferential treatment to celebs.
As for Paris, Remige said, "On any given day, a thousand female inmates are in custody. Why is one case, out of the blue, treated any different than them?"
Remige says there is a huge medical facility designed to treat inmates with health problems, and that releasing Paris should not have been a first option.
